NY can ban 'Choose Life' license plates as DMV program upheld Posted: 22 May 2015 11:49 AM PDT A divided federal appeals court gave New York wide authority to regulate the content of custom license plates, and reversed a lower court ruling ordering the state to let an adoption advocacy group put the words "Choose Life" on its own plates. By a 2-1 vote, the 2nd U.S. Circuit Court of Appeals said the commissioner of the state Department of Motor Vehicles had "broad discretion" to decide which plates to permit, and did not violate the First Amendment free speech rights of the Children First Foundation in rejecting the "Choose Life" plates. Writing for the majority, Circuit Judge Rosemary Pooler said the content of custom plates was "private speech" and the plates themselves a "nonpublic forum." She said it followed that the DMV's uniform policy of excluding controversial, politically sensitive messages from plates, which the agency said stemmed from highway safety concerns, was "reasonable and viewpoint neutral, which is all that the First Amendment requires." The 2nd Circuit ruled as the U.S. Supreme Court prepares to decide whether Texas violated the First Amendment by rejecting a custom plate bearing the Confederate flag, on concern the plate and others like it might offend people. |

Exclusive: Lax biosecurity found on several Iowa bird flu farms Posted: 21 May 2015 02:30 PM PDT By Tom Polansek and P.J. Huffstutter IRETON, IOWA/CHICAGO (Reuters) - Measures to control the worst bird flu outbreak in U.S. history are not being enforced at several farms at its epicenter in northwestern Iowa, potentially increasing the risks that the disease could spread further, spot checks by Reuters show. In visits to six affected sites in Iowa last week, a Reuters reporter found procedures at three in Sioux County did not comply with USDA or state protocols for restricting access to infected sites, providing protective gear to workers and cleaning the wheels of vehicles leaving the sites. Burke Healey, the USDA's national incident commander coordinating response to the bird flu, said he was concerned about the findings of lax biosecurity in Iowa after hearing about them from Reuters. |
Suit filed over South Carolina war memorial that separates dead by race Posted: 21 May 2015 02:12 PM PDT By Harriet McLeod CHARLESTON, S.C. (Reuters) - Five veterans have sued South Carolina for the right to replace bronze plaques on a public memorial that separate those who died in the country's two world wars under the headings of "white" and "colored." "We just did not think it was appropriate to honor those who died for our country in such a segregationist fashion," said attorney Clarence Rauch Wise, who sued on behalf of the veterans in Greenwood, South Carolina. The Greenwood memorial was erected in 1929 to honor local residents who died in World War One and was later updated to add World War Two dead. The law was intended to protect a new monument to the Confederate dead on the State House grounds. |
