Arabs, Muslims can sue U.S. officials over post-9/11 jail treatment

By Jonathan Stempel NEW YORK (Reuters) - A divided U.S. appeals court said the federal government's top law enforcers can be sued by former inmates who claim their civil rights were violated while jailed after the Sept. 11, 2001 attacks because they were Arab, Muslim or stereotyped that way. Wednesday's 2-1 decision by the 2nd U.S. Circuit Court of Appeals prompted an impassioned dissent that the ruling could make it harder to protect the country against terrorism. The court revived claims against Bush administration officials including Attorney General John Ashcroft, FBI director Robert Mueller and Immigration and Naturalization Services Commissioner James Ziglar by former inmates at Brooklyn's Metropolitan Detention Center.

FBI arrests man in New York as part of terrorism probe

FBI agents in New York on Wednesday arrested a man in the borough of Staten Island as part of a larger terrorism-related investigation, an FBI spokeswoman said. The arrest by the Federal Bureau of Investigation came a day after U.S. officials accused a New York college student of plotting to set off a pressure-cooker bomb in support of the Islamic State militant group. The spokeswoman, Kelly Langmesser, declined to identify the man arrested on Wednesday or comment on media reports that he became violent.

The dismissal leaves a panel of 19 jurors, including 14 women and five men, to hear the murder trial of former neuroscience graduate student James Holmes, who is charged with fatally shooting 12 people and wounded 70 others during the premiere of a Batman film at a Denver-area multiplex. Arapahoe County District Judge Carlos Samour said he was letting the latest juror go because she had not been entirely open about knowing a wounded survivor of the rampage who testified during the trial's second week.

Uber drivers are employees, not contractors: California Labor Commission

A San Francisco-based driver for ride-hailing service Uber is an employee, according to a ruling by the California Labor Commission. The ruling earlier this month and filed Tuesday in state court in San Francisco, said Uber is "involved in every aspect of the operation." Uber has argued its drivers are contractors, not employees. Uber is appealing a labor commissioner award of about $4,000 in expenses to the driver.

Economists predict shockwaves if Obamacare subsidies are nixed

By Sharon Begley and Caroline Humer NEW YORK (Reuters) - As the U.S. Supreme Court prepares to rule on whether people in 34 states can continue to receive Obamacare health insurance subsidies, economists are projecting billions of dollars in lost healthcare spending for hospitals, drugstores and drugmakers if the justices say the payments are illegal. The immediate consequences of such a ruling would fall on the 6.4 million people who receive the subsidies and live in states that did not establish their own insurance exchanges under President Barack Obama's healthcare law, instead relying on the federal HealthCare.gov website. The case, known as King v Burwell, would not affect subsidies in the District of Columbia or in the 13 states that run their own exchanges.

Massachusetts murderer's lawyers seek move for death-penalty retrial

Lawyers for a man who pleaded guilty to three murders after a Massachusetts carjacking more than a decade ago are due in court on Wednesday to ask that the trial to determine whether he is sentenced to death be moved out of state. Gary Lee Sampson in 2003 was sentenced to death in federal court to murdering two men who had picked him up while he was hitchhiking and later killing a third man after he fled to New Hampshire. Defense lawyers argued in court filings before Wednesday's hearing that the intense publicity surrounding Sampson's case, as well as the recent trial of Boston Marathon bomber Dzhokhar Tsarnaev, who was also sentenced to death by lethal injection, would make it impossible to seat an impartial jury in Boston.

U.S. authorities have accused a New York City college student of plotting to set off a pressure cooker bomb in the city in support of the militant group Islamic State, according to court documents made public on Tuesday. Munther Omar Saleh, 20, was arrested early on Saturday morning after he and another man got out of their car and ran toward a surveillance vehicle that had been tracking their movements, according to documents filed in federal court in Brooklyn. A defense lawyer for Saleh could not be identified on Tuesday.
